Requirements for Participants in Procurement Procedures

Every company wants to work with a training organization that is just as interested in the quality of personnel training as the employer. However, the educational services market continues to be saturated with companies that sell "certificates" rather than actual knowledge and skills.

How can you protect yourself from unscrupulous suppliers during the selection stage and contract execution? I will share my experience.

  1. Qualifications of the contractor's personnel involved in service delivery. The customer's requirements regarding personnel qualifications may take into account the provisions of regulatory legal acts and local internal regulations (if any). If your needs require training to be conducted in several locations, it is possible that the need for training may arise simultaneously. Accordingly, the contractor must confirm the availability of the required number of specialists on staff (full-time or part-time) or those engaged under civil law contracts. As supporting documents, we request proof of specialist availability (staffing table) and information on their qualifications (education and/or qualification documents, knowledge check protocols, etc.).
  2. Training program. In this section, specify the requirements for the training program content in as much detail as possible (list of topics, number of theory hours, volume of practical exercises), the mode of study, and the format of the final assessment (knowledge check): testing, practical exam, etc. As supporting documents, we request the training program, examples of test questions, and practical assignments.
  3. Post-training documentation. Specify requirements for the documents to be issued upon completion of training and the procedure for their transfer to the customer. As supporting documents, we request document samples.
  4. Material and technical resources. In this section, specify requirements for equipment and personal protective equipment (PPE), including a specific list with analogs required for the training. The number of items is calculated based on the number of trainees in one group. As supporting documents, we request: copies of documents confirming ownership or lease; certificates of conformity (if necessary).
  5. Experience in providing similar services. We request information on previously completed contracts, including contact persons. At your discretion, you can set requirements for the volume of completed contracts, for example: over the last 2 years preceding the application date, the participant must have fulfilled obligations in an aggregate (total) amount of at least 50% of the initial maximum price of the lot. As supporting documents, we request: copies of contracts and certificates of services rendered.
  6. Training quality. If the quality of training is one of your key performance indicators (KPIs), you can supplement the technical requirements with this numerical indicator.
  7. Responsibility for organizing and ensuring the safety of the educational process. During the provision of services, the contractor must be responsible for organizing and ensuring the safety of the educational process.

Requesting supporting documents will help filter out contractors who send their standard document packages to electronic trading platforms without carefully reading the technical requirements for the procurement.

During the training, we evaluate the quality of service delivery using checklists compiled based on the technical requirements. In case of non-compliance, we file a claim regarding the improper quality of the services provided, referencing the specific clauses of the technical requirements.

If the requirements are not met, the customer reserves the right to unilaterally terminate the contract out of court and demand full compensation for losses due to the improper quality of service delivery.
